These Terms and Conditions (“T&C”) outline the agreement between Vaz Entertainment (“the Provider”) and the Client (“you”). By booking our services, you agree to comply with the following terms:
1. Services Provided
1.1 Vaz Entertainment offers entertainment services, including but not limited to DJ and MC services, live musicians, photo booths, dry ice, sparkler machines, uplighting, dance lighting, and other event-related services.
1.2 Specific services will be outlined in the contract based on the Client’s requirements.
1.3 The Provider agrees to supply entertainment services as specified in the booking confirmation.
2. Booking and Payments
2.1 A non-refundable deposit (specified percentage or dollar amount) is required at the time of booking to secure the date.
2.2 The remaining balance is due within 5 business days before the event date unless otherwise agreed in writing.
2.3 Payment methods accepted include credit card, bank transfer or cash payment.
2.4 Late payments incur a fee of 10% per day after the due date.
2.5 In the event of any damage to the Provider’s equipment, the Client agrees to pay any additional costs for repair or replacement as outlined in Clause 6. These costs will be invoiced separately and must be paid within 3 days of receiving the invoice.
3. Cancellation and Refund Policy
3.1 Any deposits paid are strictly non-refundable.
3.2 If the Client cancels ANY booked services at any time, a cancellation fee of $500 will apply. Cancellations must be made in writing at least 90 days before the event to avoid further charges.
3.3 If the Client cancels within 90 days of the event, the full contracted amount will remain payable.
3.4 If the Client cancels any add-on services (including but not limited to live musicians, photo booths, video booths, 360 booths, lighting) the deposit(s) for these services will be forfeited, and a cancelation fee of $500 will apply.
3.5 In the unlikely event that the Provider must cancel due to unforeseen circumstances, all payments, including the deposit(s), will be refunded in full.
4. Event Details and Requirements
4.1 The Client must provide accurate event details, including the date, time, location, and any specific (reasonable, as deemed by the Provider) requirements.
4.2 The Client is responsible for ensuring the venue provides access to sufficient power supply, space, cover, and other technical needs for the Provider’s equipment.
4.3 Any changes to the event details must be communicated in writing at least 14 days in advance.
5. Provider Liability
5.1 The Provider is not liable for any delays or cancellations caused by events outside their control, including but not limited to natural disasters, government restrictions, or unforeseen technical issues.
5.2 The Provider’s liability for damages arising from their services is limited to the total amount paid by the Client.
6. Client Liability
6.1 The Client will be held liable for any damage to the Provider’s equipment during the event (as well as bump in and bump out) caused by the Client, their guests, staff, or any third-party present.
6.2 The Provider must alert the Client of any damage made to their equipment within 24 hours of the event.
6.3 In the event of damage, the Client agrees to cover the cost of:
- Repair by a certified repairer (chosen by the Provider), or
- Replacement at retail value, should repair be deemed unfeasible.
7. Use of Media
7.1 Vaz Entertainment reserves the right to take photos or videos during the event for promotional purposes unless the Client opts out in writing before the event.
7.2 The Client agrees that any photos or videos taken by the Provider may be used for marketing, social media, and other promotional activities.
8. Equipment and Safety (Use & Responsibility)
8.1 The Client acknowledges responsibility for providing a safe and suitable environment for the Provider’s equipment.
8.2 The Client agrees to ensure all equipment is kept under cover and protected from adverse conditions, including rain, wind, or direct exposure to liquids.
9. Liquid Damage
9.1 The Client acknowledges that liquid damage is a significant risk to electrical equipment. The Client agrees to prevent the placement of drinks or liquids near the Provider’s equipment.
9.2 If damage occurs due to liquid exposure, the Client agrees to the terms of repair or replacement as stated in Clause 6.
10. Indemnification
10.1 The Client agrees to indemnify and hold harmless the Provider from any claims or losses arising due to misuse or neglect of the equipment by the Client, event attendees, staff or any third-party present.
11. Client Conduct
11.1 The Client is responsible for ensuring the safety and respectful conduct of their guests.
11.2 The Provider reserves the right to terminate services immediately if they feel unsafe or threatened during the event. In such cases, full payment is still required and no refund will be provided.
12. Additional Services and Changes
12.1 Additional services requested on the day of the event will incur extra charges (granted it is feasible to provide the services).
12.2 Any amendments to the agreed-upon services must be confirmed in writing and will be subject to additional fees.
13. Force Majeure
13.1 Vaz Entertainment shall not be held liable for failure or delay in fulfilling their obligations under this Agreement if such failure or delay is caused by circumstances beyond their reasonable control, including but not limited to: Natural disasters (flood, earthquake, fire, storm, etc.); Government restrictions, pandemic regulations, or public health emergencies; Acts of terrorism, war, or civil unrest; Power outages or technical failures outside the Provider’s control. In the event of such circumstances: Both parties agree to notify each other as soon as reasonably possible; Efforts must be made to reschedule or adapt the event where feasible; Payments for services already rendered remain due, but no penalties shall be applied for non-performance caused directly by the Force Majeure event.
14. Governing Law
14.1 These Terms and Conditions are governed by the laws of the Australian Federal Jurisdiction, and any disputes shall be resolved in accordance with these laws.
All policies apply irrespective of the payment method.
Acknowledgment and Acceptance
By booking with Vaz Entertainment, the Client acknowledges they have read, understood, and agreed to these Terms and Conditions.
